Ex-Angels employee indicted on charges tied to Tyler Skaggs' death

A federal grand jury had indicted former Angels employee Eric Kay on two charges tied to the overdose death of pitcher Tyler Skaggs, according to reports.

After being charged with conspiracy to distribute fentanyl in August, Kay, the team’s former director of communications, is now also being charged with possessing with the intent to distribute fentanyl, ESPN reported.

The 27-year-old Skaggs was found dead in his Texas hotel room on July 1, 2019 with fentanyl, ethanol and oxycodone in his system, along with alcohol, according to the toxicology report. He was found to have asphyxiated on his own vomit.

“On or about June 30, 2019 … Eric Prescott Kay, the defendant, did knowingly and intentionally distribute a mixture and substance containing a detectable amount of fentanyl, a Schedule II controlled substance, and the use of said substance resulted in the death and serious bodily injury of [Skaggs],” read the indictment filed on Friday, according to the Los Angeles Times.

Kay has not entered a plea, USA Today reported.

Investigators found pills in Skaggs’ hotel room, according to the U.S. Attorney’s office, including a single blue pill that “resembled a 30-milligram oxycodone tablet” and was laced with fentanyl. They also obtained text messages between Kay and Skaggs from the night of June 30, 2019.

“Hoe [sic] many?” Kay wrote.

“Just a few like 5,” Skaggs replied.

Skaggs later told Kay to “come by” his hotel room.

“It was later determined that but for the fentanyl in [Skaggs’] system, [Skaggs] would not have died,” an affidavit previously filed in U.S. District Court in Fort Worth said.
